Terms And Conditons Order A Car

1. General Provisions
These Terms and Conditions for “Order a Car” (or hereinafter called “T&C”) governs the relations between Liberty Carz Co. Ltd. (or hereinafter called “Liberty Carz”), a limited liability company established under the laws of Cambodia and App User (or hereinafter called “You”) with regard to “Order a Car” service feature (or hereinafter called the “Service”) provided on the Liberty Carz App and Website (or hereinafter called the “App/Website”).
2. User’s Acceptance
By using “Order a Car” service feature, User irrevocably agrees to all terms and conditions stated herein.
3. Car Information and Price
Liberty Carz aims at providing truthful and accurate information on “Order a Car” service feature. However, Users are aware that car information and price posted on “Order a Car” service feature is for information only. Liberty Carz does not provide any warranty on information and price of a car posted on “Order a Car” service feature. The actual price and information of a Car may vary from what is originally posted until final verification and confirmation by Liberty Carz through a written agreement/document. Users shall be aware that you will be not required to make any deposit or payment until information/price of a car is officially verified and confirmed. Liberty Carz shall not be legally responsible for any information, content or price of a car posted on “Order a Car” service feature, until final verification and confirmation by Liberty Carz through a written agreement/document.
4. Change of Car Information and Price
Liberty Carz reserves full right to regularly renew, amend, revise or delete information and price on “Order a Car” service feature from time to time without giving any prior notice.
5. Sale and Purchase Agreement /Additional Agreement
Sale and purchase transaction of a Car is considered as legally effective only upon the conclusion of Sale and Purchase Agreement (SPA) or Service Agreement on Ordering a Car. Other terms and conditions may be specified in such agreement.
6. Disclaimers
Users are aware of and also acknowledge that:
- Liberty Carz will not accept liability for consequential damages or losses to User or any third party as result of information and price posted on “Order a Car” service feature; and
- Liberty Carz will not accept liability for any damages resulting from the disclosure of User personal information to Liberty Carz’s third party partner(s). For clarity, Users hereby waives any right to claim such damages; and
- In case certain claims for remedies against Liberty Carz cannot be waived under this T&C, but on the other hand be compulsorily required under Cambodian laws, only a minimum and limited liability shall be resorted against Liberty Carz
- Neither us, nor our affiliations, directors, staff or service providers, shall be held liable for any loss or damage or claim, whether direct or indirect, in relation to information and price posted on “Order a Car” service feature the App/ Website.
7. Amendments
Liberty Carz reserves full right to add, amend, change or remove any part of these T&C from time to time by giving 7 days advance notice in writing.
8. Language
These T&C is made in Khmer and other languages. In case of discrepancy between languages, the Khmer version will prevail over any translation.
9. Entire Agreement
These T&C, along with any other Policies agreed to by Liberty Carz and Users constitute the entire agreement between Liberty Carz and Users and will supersede all previous oral or written presentations, agreements or commitments.
10. Applicable Law and Dispute Resolution
These T&C shall be governed by the laws of Cambodia. Any dispute arising out of or in connection with these T&C between Liberty Carz and the Users shall be resolved amicably. If the Parties are unable to resolve the dispute, either Party may submit the dispute to competent authority or court.
